General Vehicle and Equipment Terms & Conditions

  1. The auctioneers have made every effort to correctly and conscientiously describe every vehicle and piece of equipment included in this sale. However, descriptions are meant only as a guide and all buyers should inspect and examine all photos of the vehicles and equipment to their own satisfaction, and please do your research! No sale shall be cancelled or invalidated by reason of defect of accuracy of the items, by reason of being incorrectly described in the catalogue or announced by the auctioneer and no liability shall be borne by the owners of the auctioneers in respect of any defect or error.
  2. All VEHICLES ARE SOLD "AS IS". The vehicle is sold "as is" and is not represented as being in a road worthy condition, mechanically sound or maintained at any guaranteed level of quality. The vehicle may not be fit for use as a means of transportation and may require substantial repairs at the buyer's expense. It may not be possible to register the vehicle to be driven in its current condition.
    All bidders and buyers must inspect all photos of the vehicles and equipment to their own satisfaction before bidding. Again, please do your research! All items are sold without warranty or guarantee, either express or implied, on an "as-is-where-is basis" - with all defects and lie at the purchaser's risk immediately. At no time shall any claim be allowed against the owners of the auctioneer with regard to any or all defects.
  3. All vehicles are sold free and clear of any liens.
  4. The auctioneer reserves the right to accept or reject any bid and shall control the bidding at all times. Some units are sold subject to approval. Please read and listen for all the conditions on each unit. In all cases the decision of the auctioneer is final. The highest bidder, as accepted by the auctioneer, is the purchaser and no purchaser shall revoke or retract his/her bid. All sales are final!
  5. A minimum $500.00 non-refundable or transferable deposit by Visa, Mastercard or Debit is required on each vehicle or large unit purchased, or as directed by the auctioneer. This deposit is forfeited if the purchase is not complete in the allotted time. If you make no purchase the $500.00 will be refunded or not processed.
  6. $135.00 Handling and Transfer Fee is applicable on each licensed vehicle or trailer. It is the buyer's responsibility to supply the correct driver's license, dealer or RIN #'s at time of payment.
  7. All vehicles & equipment must be paid within 48 after the sale. All payments are to be made by Visa, Mastercard, debit, e-transfer, certified cheque, bank draft, or money order.
  8. Any or all safety certificates are strictly between the buyer and the seller. Safety certificates do not cover engine, transmission and other non-safety related items.
  9. All used vehicles need work for safety certificates and or mechanical fitness and all bidders must inspect the units and vehicles to their own satisfaction before bidding.
  10. Due to the increase cost of online auctions we regretfully have to add a 11% fee to all small items, and a 6% fee to all licensed vehicles with a 3.5% surcharge for those who use credit cards for their down payment.
  11. HST is applicable on all units, for all buyers except where exempted by law. Proper proof is required for exemption.
  12. Watch for moving vehicles! You are on these premises at your own risk!
  13. Any piece of equipment or vehicle that has been tampered with will not be sold!
  14. All natural gas and portable propane tanks are property of the supplier.
  15. Any vehicle you purchase through the auction must be for personal use only and not for resale unless you are a registered dealer, as per MVDA 2002.
  16. Any known vehicle recalls will be provided to the buyer.
  17. By bidding on a vehicle you acknowledge that: the vehicle is being bought “as is” and is not represented as being in a road worthy condition, mechanically sound or maintained at any guaranteed level of quality. The vehicle may not be fit for use as transportation and may require substantial repairs at my expense. It may not be possible to register the vehicle to be driven in its current condition.
